On July 31, 2010 Roy took his three sons to a late movie. On their way back to their beach rental, an impaired driver ran a red light. He had been traveling in excess of 80 mph. The significant impact pushed Roy's Ford Fusion into a concrete light pole. The impaired driver suffered a broken leg. His passenger was likewise hospitalized for other non-life threatening injuries.
The twenty year old impaired driver admitted to smoking marijuana and consuming alcohol prior to the crash. His blood alcohol level was .154. He was subsequently convicted of multiple charges, including four counts of DUI Manslaughter and sentenced to 44 years in prison.
